You agree to be bound by these Terms & Conditions by using our website. Before using our website, please carefully read these Terms.
Ordering and Payment:
• We reserve the right to accept or reject any order. We reserve the right, at our sole discretion, to reject any order.
• Prior to completing your order, payment in full is required.
• In addition to the payment options provided on our website, we also accept payments made by credit card and PayPal.
Samonde.com does not represent itself as an authorized reseller of the goods offered for sale on the website or in the quotations. The products can therefore have codes that are older in date or come from a previous production than what is offered by the official manufacturer and/or authorized dealers. When ordering, it is necessary to specify any production years and/or specific versions.
All referenced brands, logos, supplier names, and service names are registered trademarks of the respective businesses and are owned by the respective right holders. Using logos belonging to third parties does not imply support for or affiliation with the companies that own the corresponding intellectual and industrial property.
Samonde.com is an online store where industrial and naval automation products are sold. (for example, Programmable Logic Controllers, HMI Operator Panels, Motors, Drives, Motion Systems, Electronic Components, etc.).
Customers who are both consumers and those who are not may place orders with the seller. Any natural person acting for reasons unconnected to any business, professional, commercial, or craft activity is a consumer.
These general terms and conditions of sale and the Italian Civil Code shall apply if any sales are made to a party who is not a consumer because the consumer protections, which reflect or comply with mandatory legal requirements, shall not apply to that party. Only people who are at least 18 years old may make purchases.
The Customer certifies that it has read and unconditionally accepted the contents of the premises, which are an essential and significant component of this Contract.
CONDITIONS OF USE
The legal terms that apply to the buyer-seller relationship are those that were in effect when the purchase order was transmitted. They are always subject to change. Any modifications and/or additional terms shall be deemed in effect as of the time they are published on the Site.
The Customer must carefully read these terms and conditions before placing and, consequently, carrying out the payment of the order. Order placement denotes full understanding and express agreement of these terms and conditions and everything detailed in the purchasing process.
The Customer can contact the Seller using the contact information at samonde.com/contact-us and through the customer care live chat available at the same address.
The Customer is aware of, agrees to, and gives permission for all communications, notifications, information, reports, and in any case any documentation on the operations performed referring to the purchase of Products, to be sent to the email address provided at the time of registration or transmission of the order, with the option to download the information on a permanent medium in the manners and to the extent permitted by the Site.
AVAILABILITY AND CANCELLATION OF THE ORDER
All orders for products are based on their availability. To achieve the greatest possible consistency between the Seller’s availability and the availability stated on the Site, the Site is continuously and automatically updated.
The site does not show the product quantities that are available at the time of ordering, and since the concurrent access of numerous user-customers, the simultaneous possibility of “offline” orders, and the variable quantity of each product that depends on the supplying company all affect the products’ availability, the Seller cannot ensure the allocation of the ordered goods with any degree of certainty.
Subject to previous notice and the customer’s acceptance, the seller reserves the right to accept orders for some products that are the subject of price reductions by reducing their quantities; in the absence of such, the order shall be regarded canceled.
When products are not available, the Seller has the right to cancel the order. When this occurs, it must email the customer to let them know that the contract has not been finalized and to explain why the seller has not completed the order. Before offering a refund under these circumstances, the seller may suggest an alternative solution (such as a surplus rush service or a product with different terms) which must always be expressly agreed by the customer. If the replacement item is not accepted, the money that was already committed to the customer’s payment method is reimbursed. Email is used to notify recipients of the return.
In the event that the Seller cancels the order for any reason, it is intended that the Seller shall not be liable for any damages as a result of the cancellation.
The order may also be canceled free of charge by the Customer upon notice to the Seller via email at info@samonde.com, provided that the Seller has not already started working on the order (which can be seen in the “my orders” section of the website or through email notification of such initiation). The price paid must be refunded in accordance with any guidelines that the Seller may from time to time provide.
If none of the conditions outlined in the points above apply, the customer may still request a cancellation with Samonde’s approval in exchange for payment of the following: (i) administrative management fee; (ii) the cost of purchasing back-order components; (iii) transport costs; (iv) customs fees; and (v) collection and currency exchange fees, which Samonde may have already paid with respect to the canceled order. Following the cancellation request, the Customer will be informed of the full expenses. Upon the Customer’s affirmative confirmation of the costs shared by Samonde, the cancellation will take effect. The cancellation confirmation will be regarded as having been given tainted if there is no acknowledgment by 72 hours after the cancellation becomes effective. The buyer is responsible for paying any shipping costs for the returned items, which must always be sent by trackable shipping and insured if the goods’ value exceeds €500.
LIMITATION OF LIABILITY
If the Seller fails to execute the order in the time stipulated in these general terms and conditions of sale, it shall not be liable if the non-performance or defective performance results from inefficiency due to a third party’s act, the Customer’s fault, force majeure, fortuitous event, or any other event not under the Seller’s direct and exclusive control (including, but not limited to, catastrophe).
The Seller is not liable for Customer or third-party losses caused by incorrect product use.
The Seller is not liable for misuse or disclosure of the Customer’s registration/log-in information.
The Seller is not liable for any direct or indirect losses, foreseeable or not, caused by the Customer’s use of the Site. Seller’s liability for a harm caused by the transmission of an order is limited to the amount paid by the Customer.
If it can prove that it took all possible precautions in accordance with the best available technology and experience at the time and with ordinary diligence, the Seller is not liable for third parties’ fraudulent and unlawful use of credit cards and other payment methods when paying for the Products.
These General Conditions of Sale are ruled by Italian law and shall be interpreted in accordance with it, without prejudice to any different prevailing mandatory rule of the Customer’s country of habitual residence if the latter is qualified as a Consumer.
